Dirección del Trabajo actualizó su tipificador de multas

La Dirección del Trabajo (DT) actualizó su “Tipificador de hechos infraccionales y pauta para aplicar multas administrativas”, esto debido a los ajustes legales que entraron en vigencia en 2020 para enfrentar las secuelas de la crisis sanitaria. Este documento incluye el detalle de infracciones vinculadas a nuevas normativas, como por ejemplo, a las leyes de Teleoperadores, de Protección al Empleo y de Trabajo a Distancia y Teletrabajo.
Respecto a la norma que regula el teletrabajo, el listado califica como una infracción “gravísima” el no capacitar previamente al trabajador acerca de las principales medidas de seguridad y salud que debe tener presente para desempeñar las labores a distancia o teletrabajo, agregando que, dependiendo del tamaño de la empresa, la sanción puede variar entre 10 y 60 UTM.
En cuanto a la Ley de protección del empleo, se establece como sanción gravísima pactar una reducción temporal de jornada de trabajo por un periodo superior a cinco meses continuos y/o inferior a un mes, tratándose de trabajadores con contrato indefinido. Dicha infracción tiene una sanción que varía entre las 10 y 60 UTM dependiendo de la cantidad de trabajadores.
Otro de los comportamientos que la DT considera como infracción gravísima, es no respetar la suspensión de los efectos del contrato de trabajo, producida por acto de autoridad. Aquí además de la multa correspondiente, el compendio de multas agrega que la DT deberá denunciar al Ministerio Público y/o Tribunales de Justicia la infracción.
